EL TIEMPO established that the Superior Court of Bogotá has just denied the defense of former president Álvaro Uribe the precautionary measure in which he requested to stop his house arrest until a tutela ruling was made on the merits, in which he requested that the measure be evaluated for violating his fundamental rights.

Although the court of Ramiro Riaño was assigned to the court, it was the judge Leonel Rogeles Moreno who heard the constitutional action because the former is on leave.

For Judge Rogeles, there are no grounds for suspending the order issued by the judicial authority: Judge Sandra Liliana Heredia, at this point in the protection process.

And he adds that except for the disagreement of the former president's defense,"at the moment no irregularity is noted that is of the magnitude necessary to estimate a relevant affectation to the fundamental rights of the aforementioned."

The lawyer adds that with the evidence provided by Uribe's defense, it is premature to determine that Judge Heredia's decision is arbitrary,"since it will only be once the exercise of contradiction is guaranteed that it can be determined if this is the case, as described by the plaintiff."

Judge Rogeles' decision will be announced in 10 days.
