247 - The Supreme Federal Court (STF) resumed this Tuesday (9) the trial of Jair Bolsonaro (PL) and seven other allies identified as leaders of the coup plot against the result of the 2022 elections. The session is in charge of the First Panel, formed by ministers Cristiano Zanin, Cármen Lúcia, Alexandre de Moraes, Luiz Fux and Flávio Dino.
The process had begun last week, with the defense's support and the opinion of the Attorney General of the Republic, Paulo Gonet, who requested the conviction of all defendants. Now, the court enters the decisive voting phase, which can lead to the application of sentences that exceed 30 years in prison, according to the Federal Public Ministry.
Central accusations
The complaint filed by the Attorney General's Office describes the existence of the"Green and Yellow Dagger" plan, which called for violent actions such as kidnappings and even assassinations of President Luiz Inácio Lula da Silva (Workers' Party), Vice President Geraldo Alckmin (Socialist Party), and Minister Alexandre de Moraes. Another key point is the so-called"coup minutes," a document allegedly prepared to establish a state of defense and siege in an attempt to prevent the president-elect from taking office.
In addition to these elements, the group is also responsible for involvement in the acts of January 8, 2023, when the headquarters of the Three Powers were invaded and vandalized in Brasília.
Who are the defendants?
- Jair Bolsonaro – former President of the Republic
Alexandre Ramagem – former director of Abin
Almir Garnier – former commander of the Navy
Anderson Torres – former Minister of Justice and former Secretary of Security of the Federal District
Augusto Heleno – former Minister of the State Security Secretariat
Paulo Sérgio Nogueira – former Minister of Defense
Walter Braga Netto – former Chief of Staff and 2022 vice-presidential candidate
Mauro Cid – former aide-de-camp and whistleblower
Voting dynamics
Tuesday's session begins with an analysis by the rapporteur, Justice Alexandre de Moraes, who is responsible for evaluating the preliminary issues raised by the defense, such as the nullity of Mauro Cid's plea bargain and requests to withdraw the case from the Supreme Federal Court. Moraes will then present his vote on the merits.
In order of voting, after the rapporteur, Justices Flávio Dino, Luiz Fux, Cármen Lúcia, and finally, Cristiano Zanin will speak. Three votes are needed to form a majority and decide whether to convict or acquit.
Next steps
Even if the First Panel rules in favor of conviction, the defendants will not be immediately imprisoned. The defense may still file a motion for clarification or request that the case be taken to the full Supreme Court—a viable option if at least two justices on the panel vote for acquittal.
The court reserved sessions until Friday (12) to conclude the trial, which is considered one of the most relevant in recent history as it directly addresses attempts at institutional rupture after the 2022 elections.
