In ordering the house arrest of former president Jair Bolsonaro (PL), Minister Alexandre de Moraes, of the Supreme Federal Court , considered that the participation - through a cell phone call with his son, Senator Flávio Bolsonaro (PL-RJ), and with Congressman Nikolas Ferreira (PL-MG) - in public demonstrations in Copacabana and on Avenida Paulista on Sunday, 3, served as an 'attempt to coerce the STF and obstruct justice'. The decision highlights that 'a defendant who deliberately fails to comply with precautionary measures - for the second time - must suffer the legal consequences'.

Moraes states that, 'acting illicitly, Jair Messias Bolsonaro addressed the protesters gathered in Copacabana, in Rio de Janeiro, deliberately and knowingly producing pre-fabricated material for his supporters to continue trying to coerce the Supreme Federal Court and obstruct justice, so much so that the phone call with his son, Flávio Nantes Bolsonaro, was published on the Instagram platform'.

In the decision, the minister also expanded the precautionary measures already imposed. Bolsonaro will now be banned from:

  1. To receive visits, except from their lawyers and people previously authorized by the STF.
  2. To use the cell phone, directly or indirectly, through third parties.

“The flagrant disregard for the precautionary measures was so obvious that, it should be repeated, the defendant's own son, Senator Flávio Nantes Bolsonaro, decided to remove the post made on his profile on the social network Instagram, in order to hide the legal violation,” said the minister.

Mentioning the former president's participation in the demonstration on Avenida Paulista, Moraes emphasizes that 'Bolsonaro made a telephone call, via video call, with his political supporter and federal deputy, Nikolas Ferreira, demonstrating disrespect for the decision handed down by this Supreme Court, due to the clear objective of endorsing the theme of the manifestation of attacks on the Supreme Federal Court'.

The decision considers that 'the concealed participation of Jair Messias Bolsonaro, preparing pre-fabricated material for dissemination in demonstrations and on social media, clearly demonstrated that he maintained the illicit conduct of attempting to coerce the Supreme Federal Court and obstruct justice, in flagrant disregard of the precautionary measures previously imposed'.

"The conduct of Jair Messias Bolsonaro, deliberately disregarding the decisions handed down by this Supreme Court, demonstrates the need for and appropriateness of more severe measures to prevent the defendant from continually repeating his crimes, even with the imposition of precautionary measures other than imprisonment," he points out.

Moraes highlights that the call-in participation was even broadcast by Senator Flávio Bolsonaro, who later 'deleted the post with a clear intention of omitting the non-compliance with precautionary measures practiced by his father'.

According to the minister, there was a 'coordinated action by Jair Messias Bolsonaro's sons based on messages attacking the Supreme Federal Court, with the evident intention of interfering in the judgment of AP 2.668/DF'.

"Political supporters of Jair Messias Bolsonaro and his sons deliberately used the defendant's speeches and participation—even via telephone and social media—to spread attacks and encourage protesters with the clear intention of pressuring and coercing this Supreme Court," he declared.

For Moraes, 'the flagrant disregard for the precautionary measures was so obvious that, it should be repeated, the defendant's own son, Senator Flávio Nantes Bolsonaro, decided to remove the post made on his profile, on the social network Instagram, in order to omit the legal transgression'.

“In view of the repeated failure to comply with the precautionary measures previously imposed, I order the house arrest of Jair Messias Bolsonaro, to be served entirely at his residential address,” the minister decreed.

The decision adds that 'failure to comply with the rules of house arrest or any of the precautionary measures will result in their revocation and the immediate decree of preventive detention'.
