After forming a majority to convict former president Jair Bolsonaro (PL) for all five crimes attributed to him in the indictment of the coup plot, the First Chamber of the Supreme Federal Court (STF) defined the length of the sentence. Bolsonaro was sentenced to 27 years and 3 months of imprisonment in an initial closed regime.
According to the decision, he must serve 24 years and 9 months in prison and 2 years and 6 months in detention, that is, in a semi-open or open regime.
Justice Alexandre de Moraes, the reporting judge on the case, suggested the sentence and was unanimously approved. Justice Luiz Fux, the only one who supported Bolsonaro's acquittal, did not vote on the sentencing.
Bolsonaro was convicted of five crimes: armed criminal organization, coup d'état, attempted violent abolition of the democratic rule of law, damage to listed heritage, and aggravated damage to federal property.
The First Chamber of the Supreme Federal Court also fined the former president 248 times the minimum wage. The exact amount will still be calculated in the case. The minimum wage in effect at the time of the crimes is considered, and the total is then updated to the date of payment.
See how the sentences of the crucial nucleus of the coup plot turned out:
- Jair Bolsonaro: 27 years and 3 months in an initial closed regime;
- Mauro Cid (informer): 2 years in an open regime;
- Walter Braga Netto (former Minister of Defense and of the Civil House): 26 years in an initial closed regime;
- Anderson Torres (former Minister of Justice): 24 years in an initial closed regime;
- Almir Garnier (former Commander of the Navy): 24 years in an initial closed regime;
- Augusto Heleno (former Minister of the Institutional Security Cabinet): 21 years in an initial closed regime;
- Paulo Sérgio Nogueira (former Minister of Defense): 19 years in a closed initial regime;
- Alexandre Ramagem (federal deputy and former director of Abin): under vote.
WITH THE WORD, THE DEFENSE OF BRAGA NETO
We received the decision with the usual respect for the STF.
But we cannot fail to record our indignation at the fact that the Panel validated, especially, the manifest restriction of the defense that occurred in the case.
It was only days before the start of the investigation that we had access to all the elements gathered in the investigation.
The best moments of the Police and the Attorney General's Office are not full and effective access. We did not have time to analyze the material and the damage of this is evident.

On the merits, it is shocking that General Braga Netto was convicted for allegedly discussing and financing the Punhal Verde Amarelo/2022 World Cup plan.
It is proven in the records that the whistleblower lied about the visit to the General's residence. On the other hand, the whistleblower expressly acknowledged in the confrontation that he has no evidence of the alleged delivery of the money. Furthermore, the whistleblower stated more than once that he was not even aware of the Green and Yellow Dagger plan or the 2022 World Cup operation.
The Panel adopted the prosecution's narrative against General Braga Netto, despite there being no evidence of his involvement in any crime. This accusation is supported by the whistleblower's lies, which could never be the basis for a conviction.
